Terms of Service

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these age requirements and that you have the legal capacity to enter into a binding agreement.

2. Accounts

2.1 Registration

To access most features of Loop you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@thelooptravel.app if you believe your account has been compromised. We are not liable for any loss resulting from unauthorized use of your account.

2.3 One Account Per Person

Each person may maintain only one account. Creating multiple accounts to circumvent a suspension or ban is a violation of these Terms.

3. User Content

3.1 What You Post

Loop allows you to create, upload, and share content including trip posts, photos, captions, ratings, itineraries, comments, replies, and location data ("User Content"). You retain ownership of your User Content.

3.2 License to Loop

By posting User Content, you grant Loop a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works of your User Content solely for the purpose of operating, improving, and promoting the Service. This license ends when you delete your content or close your account, except where content has been shared with others and cannot be fully removed.

3.3 Your Representations

You represent and warrant that:

• you own or have the necessary rights to post your User Content;
• your User Content does not infringe the intellectual property, privacy, or other rights of any third party;
• your User Content complies with these Terms and all applicable laws.

3.4 Content Moderation

We reserve the right (but not the obligation) to review, remove, or restrict access to any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We are not responsible for User Content posted by other users.

4. Acceptable Use

You agree not to use the Service to:

• post content that is unlawful, harassing, hateful, defamatory, obscene, or that promotes violence or discrimination;
• impersonate any person or entity, or falsely claim an affiliation with any person or entity;
• post spam, unsolicited commercial messages, or pyramid schemes;
• upload viruses, malware, or any other harmful code;
• scrape, crawl, or use automated tools to access or collect data from the Service without our written consent;
• interfere with or disrupt the integrity or performance of the Service or its underlying systems;
• attempt to gain unauthorized access to any portion of the Service or any account, system, or network;
• use the Service for any purpose that violates applicable federal, state, or local law.

5. Photos and Device Permissions

Loop requests access to your device's photo library solely to allow you to attach photos to trip posts. We do not access, upload, or store photos that you do not explicitly select and submit. You may revoke this permission at any time through your device settings, though doing so will limit your ability to attach photos to posts.

6. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. You can adjust your content visibility settings (e.g., public vs. friends-only) from within the app.

7. Intellectual Property

7.1 Our Property

All content, features, and functionality of the Service, including but not limited to the Loop name, logo, design, software, text, and graphics, are owned by or licensed to Loop and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission.

7.2 Feedback

If you submit ideas, suggestions, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use that Feedback for any purpose without any obligation to you.

7.3 App Store Distribution

If you accessed or downloaded the Service from Apple's App Store, you acknowledge that: (a) these Terms are between you and Loop only, and not with Apple, Inc.; (b) Apple has no obligation to provide maintenance or support for the Service; (c) Apple has no warranty obligation whatsoever with respect to the Service; (d) Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession and use of the Service; (e) Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the Service or your possession and use of the Service infringes a third party's intellectual property rights; and (f) Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

8. Third-Party Content and Services

The Service may display images sourced from third-party providers (such as Unsplash) and may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies. We do not endorse any third-party content displayed through the Service.

9. Disclaimers

Travel information shared by users on Loop is user-generated and for informational purposes only. We make no representations about the accuracy, completeness, or safety of any destination, itinerary, or travel recommendation posted on the Service. Always verify travel information independently and consult official sources before making travel decisions.

10. Limitation of Liability

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above exclusions may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Loop and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may delete your account at any time through the app settings.

Upon termination, your right to use the Service will immediately cease. Sections 3.2, 7, 9, 10, 11, 13, and 14 of these Terms shall survive any termination.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms in the app and update the "Last Updated" date above. If the changes are material, we will provide additional notice (such as a push notification or in-app message). Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Loop with respect to the Service and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
